The landmark decision of the House of Lords in Stack v Dowden [2007] UKHL 17 has important implications in respect of quantifying beneficial ownership in shared home cases. This area of law was memorably described by one leading judge as being akin to “a witch’s brew”. It was the stated aim of the House of Lords to bring clarity and certainty to this area of law. Have they succeeded in this aim or is the “witch’s brew” as opaque as ever?

It is the purpose of this seminar to look not only into the quantification of shares but also into the question of equitable accounting, occupation rents and into the impact of Stack v Dowden when the dispute is not merely between the co-habitants but involves creditors in particular in the context of bankruptcy.

This seminar will be of interest to all solicitors, especially those who specialise in property law, family law and trusts.
